EEL – Educators Employment Liability

 

The AEA/NEA Educators Employment Liability (EEL) Insurance Program provides coverage to all AEA member in all membership categories.

How much coverage is provided? Up to $1,000,000 in coverage for all cases except where the member is alleged to have violated the civil rights of another. In those cases, the coverage limit is $250,000.

How do I obtain coverage? You do not have to do anything. Coverage is an automatic benefit of membership.

Is the coverage limited to incidents that occur on school grounds? No.

Does this policy cover criminal charges? In certain instances, yes. This coverage will reimburse up to $35,000 in attorney’s fees and court costs when the charges result from employment related activities. If the case is based on the administration of corporal punishment, the costs will be reimbursed regardless of the outcome. If the case does not involve corporal punishment, then costs will only be reimbursed if the member is exonerated.

Does this insurance provide legal expense coverage for other types of lawsuits? No.

Does this policy provide coverage that applies specifically to support personnel? Yes. Specific coverage is spelled out in the policy for cafeteria workers, security guards, and limited coverage for bus drivers. This coverage is in addition to the general coverage afforded by the policy.

Are there any other exclusions or limitations? Yes. This policy does not provide protection for personal business pursuits. It also includes standard exclusions for intentional injuries and lawsuits brought by members of the same employing school board.

How do I report a claim? If you receive a lawsuit, a demand letter from a lawyer threatening litigation, or an incident occurs that you believe would involve EEL coverage, you should immediately call the AEA Legal Department at 1-800-392-5839. You will then be instructed on how to file a claim.
